1. Acceptance of Terms
By accessing or using the Angie Winners Kitchen website at angiewinnerskitchen.com (the "Site") or placing an order through our online ordering system, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Site or services.
2. About Us
Angie Winners Kitchen is an African restaurant located at 2905 East Arkansas Lane, Suite 100, Grand Prairie, TX 75052. We offer dine-in, pickup, and delivery services. You can reach us at (630) 544-0043 or chefangiewinnerskitchen@gmail.com.
3. Conduct and Supervision of Minors
Parents, guardians, and supervising adults are responsible for supervising any minors accompanying them at our restaurant and for keeping children under their control at all times. You agree to take reasonable steps to prevent disruptive, unsafe, or disorderly conduct that could disturb other guests, interfere with our staff, or damage our property or that of others. We may ask any guest to leave if behavior is unsafe or unreasonably disruptive, in our sole discretion.
4. Online Ordering
When you place an order through our Site, you agree that:
- All information you provide (name, phone number, email, delivery address) is accurate and complete.
- You are at least 18 years old or have parental consent to place an order.
- Menu items, prices, and availability are subject to change without notice.
- We reserve the right to refuse or cancel any order at our discretion, including due to menu item unavailability, pricing errors, or suspected fraud.
- Order confirmation does not guarantee fulfillment if circumstances beyond our control arise.
5. Pricing and Payment
All prices listed on our Site are in US dollars. Prices include the base cost of menu items but do not include applicable taxes, delivery fees, or processing fees, which are calculated and displayed at checkout before payment.
Payments are processed securely through Stripe. We accept major credit cards and debit cards. By providing your payment information, you authorize us to charge the total amount shown at checkout. We do not store your full credit card details on our servers.
6. Pickup Orders
For pickup orders, you are responsible for collecting your order at our restaurant within a reasonable time of the estimated pickup time. Orders not picked up within 1 hour of the estimated time may be discarded, and no refund will be issued.
7. Delivery Orders
Delivery services are provided through Uber Direct, a third-party delivery platform. By choosing delivery, you acknowledge and agree that:
- Delivery availability depends on your location and driver availability in your area.
- Delivery fees are determined by Uber Direct based on distance and demand, and are displayed before you confirm your order.
- Estimated delivery times are approximate and may vary due to traffic, weather, or other factors.
- We are not responsible for delays or issues caused by the third-party delivery service once the food has left our restaurant.
- You must provide accurate delivery address and contact information. We are not responsible for failed deliveries due to incorrect information.
- In rare cases, a delivery driver may not be available. If this occurs, our team will contact you to arrange an alternative (pickup or rescheduled delivery).
8. Refunds and Cancellations
Once an order has been confirmed and is being prepared, it generally cannot be cancelled. Refunds may be issued at our discretion in the following circumstances:
- Order was not fulfilled due to an error on our part.
- Food quality was significantly below reasonable expectations.
- Delivery was not completed and the food was not received.
- Incorrect items were delivered.
To request a refund, please contact us at (630) 544-0043 or chefangiewinnerskitchen@gmail.com within 24 hours of your order. If we approve a refund or need to reverse a charge, the actual refund or reversal is processed by Stripe, our third-party payment processor, because Stripe holds and settles the payment—not our restaurant directly. Approved amounts are returned to your original payment method; timing may depend on Stripe, your bank, and card network rules, and may take approximately 5–10 business days (or longer in some cases) to appear on your statement. Stripe's terms and policies apply to how payments and refunds are handled.
9. Allergies and Dietary Information
While we strive to provide accurate descriptions of our menu items, our kitchen handles common allergens including nuts, shellfish, dairy, gluten, and eggs. We cannot guarantee that any item is completely free from allergens. If you have a severe food allergy, please contact us before placing your order.
10. Intellectual Property
All content on the Site, including text, images, logos, menu descriptions, and design elements, is the property of Angie Winners Kitchen and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without prior written permission.
11. Limitation of Liability
To the maximum extent permitted by law, Angie Winners Kitchen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, including but not limited to food allergies, delivery delays, or service interruptions.
Our total liability for any claim arising from an order shall not exceed the total amount you paid for that specific order.
12. Third-Party Services
Our Site uses the following third-party services:
- Stripe — for secure payment processing; refunds and payment reversals are issued through Stripe
- Uber Direct — for delivery fulfillment
- Google — for address autocomplete and analytics
Your use of these services is subject to their respective terms and privacy policies.
13. Changes to Terms
We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated terms.
14. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the courts of Dallas County, Texas.
